-I had a former employee who would make up stories, gosspip, spread rumors....etc. I never wrote her up for any of those because it was hearsay, wasn't sure how i could prove it. But i did keep notes about all the incidents.
I did give her a formal warning for something different a few weeks ago and also told her she needs to stop the gossip. A few days later she quit. I can prove she quit and wasn't fired.
Problem is, she's telling clients she was fired, is making up the reason why, and also is accusing me of doing the same thing....saying i'm a hypocrite. She can say whatever she wants about me, i really don't respect her enough to care, but its upsetting the clients who are buying into her story.
She's also making up some other stories. These , i'm not sure the full extent, but what i heard so far, a bit creepy.....nothing illegal, but i wouldn't do business with me if they were true.
I figure its ok for me to say she quit. When clients reply with, she's saying she was fired.....can i flat out say she's a liar. I have witness to prove she quit, and without them, i still have something up my sleeve that 100% proves she quit. Can i mention she was warned and that it was for legitimate reason or do i have to keep things broad and generalized.
I can't sue her if i loose clientele, she has nothing. I think she's going to jail for unrelated reasons anyways in a few months.I don't know what the laws are where you are at but here in Texas employers can not release information about employee termination or their resignment without that employees consent. It could be federal but I am not sure
But what she is doing is actually good grounds for a civil case, if you can prove that she is saying this and that she is making you lose business then you can most definately take her to civil court. check with your attourny and if you don't have one you need to have one on retainer.
